By accessing or using Magic Muscle AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Magic Muscle AI reserves the right to modify these terms at any time. We will provide notice of any significant changes. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

2. Description of Service

Magic Muscle AI provides an AI-powered image generation service that allows users to create fitness-related images. The Service includes image generation, face swapping, and other related features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content.

3. User Accounts

To use certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree to provide accurate and complete information when creating an account and to update your information to keep it accurate and current.

4. User Content

You retain ownership of any content you upload to the Service. However, by uploading content, you grant Magic Muscle AI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content for the purpose of providing and improving the Service.

You are solely responsible for your content and the consequences of uploading it. You represent and warrant that you have all necessary rights to upload the content and that it does not violate any third-party rights or applicable laws.

5. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms of Service. Prohibited uses include, but are not limited to:

• Creating or sharing content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity
• Interfering with or disrupting the Service or servers or networks connected to the Service
• Attempting to gain unauthorized access to the Service, other accounts, or computer systems
• Using the Service to generate content that infringes on intellectual property rights

6. Payment and Credits

Certain features of the Service require the purchase of credits. All purchases are final and non-refundable unless otherwise required by law.

We use Stripe as our payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy.

7. Third-Party Services

The Service integrates with various third-party services to provide its functionality. By using the Service, you acknowledge and agree that:

• Google Analytics: We use Google Analytics to collect and analyze usage data. Your use of the Service is subject to Google's Privacy Policy.
• Stripe: We use Stripe for payment processing. Your payment information is subject to Stripe's Privacy Policy and Terms of Service.
• Mixpanel: We use Mixpanel for analytics and user behavior tracking. Your usage data is subject to Mixpanel's Privacy Policy.
• AWS (Amazon Web Services): We use AWS for hosting and storage. Your data stored on AWS is subject to Amazon's Privacy Policy.
• OpenAI: We use OpenAI's technology for image generation. Your prompts and generated content may be processed by OpenAI and are subject to OpenAI's Privacy Policy.
• RemakerAI: We use RemakerAI for certain image processing features. Your images may be processed by RemakerAI and are subject to their Privacy Policy.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Magic Muscle AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit permission.

9. Limitation of Liability

To the maximum extent permitted by law, Magic Muscle AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, or other intangible losses.

In no event shall our total liability to you for all claims exceed the amount you have paid to Magic Muscle AI in the past six months.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms of Service.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms of Service shall be subject to the exclusive jurisdiction of the courts in the United States.
